Terms of service

1. Acceptance of terms

By accessing or purchasing from the Overide Active website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or place an order.

2. About us

Overide Active is an Australian activewear brand. Our store is operated using Shopify, and our marketing is delivered via Klaviyo (email and SMS) and Meta Ads (Facebook and Instagram).

3. Products and pricing

  • All prices are listed in Australian Dollars (AUD) and include GST where applicable.
  • We reserve the right to change prices, product descriptions, and availability at any time without notice.
  • We make reasonable efforts to display product colours and details accurately, but slight variations may occur due to screen display and manufacturing.

4. Orders and payment

  • By placing an order, you are making an offer to purchase, which we may accept or decline, for example due to stock errors, pricing errors, or suspected fraud.
  • Payment is processed securely through Shopify's payment infrastructure. We do not store your full card details.
  • Order confirmation does not guarantee stock availability. If an item becomes unavailable after ordering, we will notify you and issue a full refund for that item.

5. Shipping and delivery

Shipping timeframes, costs, and international delivery terms are set out in our separate Shipping Policy, which forms part of these Terms.

6. Returns and refunds

Our Refund Policy sets out the process, timeframes, and conditions for returns, exchanges, and refunds. Nothing in that policy limits your rights under the Australian Consumer Law guarantees below.

7. Australian Consumer Law guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Specifically, our products are guaranteed to:

  • be of acceptable quality, meaning safe, durable, free from defects, and acceptable in finish;
  • match their description and any sample or demonstration model; and
  • be fit for the purpose they are commonly sold for.

These consumer guarantees exist independently of, and in addition to, our Refund Policy, and cannot be excluded, restricted, or modified. If a product you purchased has a problem covered by these guarantees, contact us at official@overideactive.com and we will assess your claim in accordance with the ACL.

8. Intellectual property

All content on this website, including the Overide Active name, logo, product designs, photography, and written content, is owned by or licensed to Overide Active and protected by copyright and trademark law. You may not reproduce, distribute, or use this content without our written permission.

9. Acceptable use

You agree not to use our website for any unlawful purpose, to attempt unauthorised access to our systems, or to engage in conduct that disrupts or interferes with the site's operation or other users' experience.

10. Third-party links and services

Our site and marketing may link to or integrate with third-party platforms, including Shopify, Klaviyo, and Meta. We are not responsible for the content, policies, or practices of third-party services.

11. Limitation of liability

To the maximum extent permitted by law, Overide Active's liability for any claim arising from your use of our website or products is limited to the value of the relevant order, except where such limitation is not permitted under the Australian Consumer Law.

12. Changes to these terms

We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
